Driver's 4th DWI charge comes after motorcyclist's death on Capital Boulevard

Police charged the driver of a tow truck with drunk driving and other offenses after they say he hit two motorcycles and a car at the intersection of Capital Boulevard and Trawick Road early Friday morning. 

Allen Guerrero, 39, was arrested about 3 a.m. 

One motorcyclist was killed in the crash, and the other was taken to a nearby hospital with serious injuries. Two people in the car were taken to the hospital. Police said the passenger in the car has life-threatening injuries.

Police say Guerrero made an illegal U-turn on a red light and ran into the motorcycles and the car. Guerrero is the owner of the towing company, 6G Towing and Recovery. 

He is charged with: 

• Aggravated felony death by vehicle
• Felony serious injury by vehicle [3 counts]
• Driving while impaired
• Driving while license revoked
• Resisting a public officer
• Intoxicated and disruptive

He was also issued traffic tickets for:

• Failure to stop at a red light
• Unsafe movement that resulted in a crash, inflicting serious injury
• Unsafe movement

Family members of the motorcyclists identified them as cousins Chandler Hodge, 35 and Larry Pulley. 

Hodge was killed in the crash, and Friday was his birthday. He leaves behind a set of twins. 

Pulley is in the hospital with a head injury and injury to his kidneys. He is alert and stable, but does not remember what happened, according to family. 

Guerrero is being held at the Wake County jail on two separate secured bonds, totaling $500,000. He will appear in court on Monday. 

He is facing his fourth DWI charge. He currently has a suspended license due to previous DWI charges, including a conviction from last year. 

Previous DWI charges are as follows:

• 8/6/11: BAC .10
• 10/14/16: BAC .14
• 4/8/24: BAC greater than .15

The legal limit in North Carolina is .08. He lost his license for this second DWI charge in 2016.
