Police: Fatal Raleigh shooting began as argument, ended when witness intervened

One person died after being shot Tuesday morning in Raleigh during a confrontation that began as an argument.

Before 11:15 a.m., officers responded to a neighborhood on Summit Avenue near Maywood Avenue. Sky 5 flew overhead, showing yellow tape in front of a home and several police cars in the street.

Emmanuel Graham died from his injuries. He was 39 years old.

Police officers appeared to be talking to neighbors.

Police said Graham and another man got into an argument that escalated. Graham used a weapon to hurt the other man and continued to assault him, according to their early investigation. 

A witness in the Summit Avenue area saw the fight and believed the other man was in immediate danger. In response, the witness retrieved a handgun and shot Graham once. 

After reviewing the circumstances, the Wake County District Attorney's Office will not pursue charges against the witness, police said. No arrests have been made as of Wednesday.

An investigation is ongoing.
