Sentencing delayed in killing of downtown Raleigh restaurant manager

Sentencing was delayed on Monday in the killing of a Raleigh restaurant manager.

Tyrell Moore was set to hear his sentence, but got sick and had to leave the courtroom. He was brought back in later with EMTs by his side.

Moore is pleading guilty to killing David Millette in 2023. Prosecutors say Moore punched Millette while he wasn't looking on Glenwood South, causing Millette to fall and hit his head on the sidewalk. Millette died six days later. Millette was the general manager at Midwood Smokehouse in downtown Raleigh's Smoky Hollow development.

Tracy Millette, David Millette's mother, spoke in court on Monday.

"No parent should ever have to bury their child," Tracy Millette said. "I will love and miss my son for the rest of my days, and forever carry the weight of his absence in my heart. Happy heavenly birthday, my sweet boy."

Moore's bond was revoked and he will remain in custody while being treated. He will spend at least three years and two months behind bars as part of the agreement.

Moore is expected to be back in court to finish sentencing on Tuesday morning.
